Welcome to Portiqo! By accessing and using Portiqo ("Service," "Platform," "we," "us," or "our"), you agree to be legally bound by these Terms of Service ("Terms," "Agreement"). This is a binding legal agreement between you and Portiqo.

- Host and share: Get a publicly accessible portfolio URL to share with clients and employers
- Manage content: Easily update projects, skills, experience, and contact information
- Track engagement: See who views your portfolio and how they interact with it
3. User Accounts
3.1 Eligibility and Account Creation
To use our Service, you must:
- Age requirement: Be at least 16 years of age (or the age of majority in your jurisdiction)
- Accurate information: Provide truthful, accurate, and complete registration information
- Single account: Create only one account per person (no duplicate accounts)
- Legal capacity: Have the legal capacity to enter into this binding agreement
- Compliance: Not be prohibited from using the Service under applicable laws
3.2 Account Security and Responsibilities
You are fully responsible for:
- Confidentiality: Maintaining the security and confidentiality of your login credentials

- ❌ Distribute or promote illegal content, products, or services
- ❌ Engage in fraudulent, deceptive, or misleading practices
Harmful or Malicious Conduct
- ❌ Upload viruses, malware, ransomware, or other malicious code
- ❌ Attempt to gain unauthorized access to our systems, servers, or databases
- ❌ Conduct security testing, penetration testing, or vulnerability scanning without permission
- ❌ Interfere with or disrupt the Service, servers, or networks
- ❌ Bypass any security measures or access controls
Abusive or Harmful Content
- ❌ Post content that is offensive, defamatory, obscene, or hateful
- ❌ Harass, threaten, abuse, or harm others
- ❌ Promote violence, terrorism, or dangerous activities
- ❌ Share sexually explicit or suggestive content involving minors

Spam and Misuse

- ❌ Create multiple accounts to abuse free tier limits
- ❌ Impersonate others or misrepresent your identity or affiliation
- ❌ Manipulate metrics, analytics, or engagement statistics
Commercial Misuse
- ❌ Resell, sublicense, or redistribute our Service without authorization
- ❌ Use the Service to compete with Portiqo or create a similar product
- ❌ Extract or scrape data for commercial purposes
- ❌ Reverse engineer, decompile, or disassemble our software
⚠️ Violation Consequences: We reserve the right to suspend or terminate accounts that violate these terms, without prior notice or refund.
5. Content Ownership and Intellectual Property Rights
5.1 Your Content - You Own It
You retain full ownership of all content you create, upload, or publish through your portfolio, including:
- Text, descriptions, and blog posts
- Images, photos, and graphics
- Videos and multimedia content
- Project files and case studies
- Your personal information and biography
License You Grant Us: By uploading content to Portiqo, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Host and store: Keep your content on our servers
- Display publicly: Show your portfolio to visitors (if you make it public)
- Backup and replicate: Create copies for disaster recovery and service reliability
- Process and optimize: Resize images, transcode videos, and optimize performance
- Share via your links: Allow others to view content you choose to share
- Anonymize for analytics: Use aggregated, anonymized data to improve our Service
This license exists solely to operate the Service and ends when you delete your content or account.
5.2 Content Responsibility
You represent and warrant that:
- You own or have rights to all content you upload
- Your content does not infringe third-party intellectual property rights
- You have obtained all necessary permissions, licenses, and releases
- Your content complies with all applicable laws and these Terms
5.3 Our Content and Intellectual Property
All aspects of the Service are owned by Portiqo and protected by copyright, trademark, patent, and other intellectual property laws, including:
- Software and code: Platform technology, algorithms, and features
- Templates and designs: Pre-made portfolio templates and layouts
- Branding: Portiqo name, logo, and trademarks
- Documentation: User guides, tutorials, and help content
- UI/UX design: Interface design, user flows, and visual elements
You may NOT:
- Copy, reproduce, or redistribute our templates outside the Service
- Reverse engineer, decompile, or disassemble our platform
- Remove, obscure, or modify proprietary notices or branding
- Use our trademarks or branding without written permission
- Create derivative works based on our Service
6. Pricing, Subscriptions, and Payment
6.1 Free Tier
We offer a free tier to help you get started. Free accounts include basic features but have limitations on:
- Storage: Limited storage capacity for images and files
- Custom domains: Free accounts use Portiqo subdomains (e.g., yourname.portiqo.app)
- Templates: Access to basic templates only
- Features: Limited access to advanced customization and analytics
- Support: Community support only (no priority support)
- Branding: "Powered by Portiqo" footer branding
6.2 Paid Subscriptions (Premium Plans)
Paid subscriptions unlock premium features and enhanced capabilities:
Billing Terms
- Billing cycle: Choose monthly or annual billing (annual plans receive a discount)
- Advance payment: Subscription fees are charged in advance at the start of each billing period
- Auto-renewal: Subscriptions automatically renew unless you cancel before the renewal date
- Currency: All prices are in USD unless otherwise stated
- Payment methods: We accept major credit cards, debit cards, and other payment methods via our payment processor
Refund Policy
- No refunds: All subscription fees are non-refundable, except as required by law or our discretion
- Pro-rata refunds: Not available for partial billing periods
- Money-back guarantee: We offer a 14-day money-back guarantee for first-time annual subscribers
- Chargebacks: Unauthorized chargebacks may result in account suspension
Price Changes
- We may change subscription fees at any time
- You'll receive 30 days' advance notice of price increases
- Price changes take effect at your next renewal date
- If you don't agree to the price increase, you may cancel before renewal
6.3 Subscription Management and Cancellation
You have full control over your subscription:
How to Cancel
- Cancel anytime through your account settings
- No cancellation fees or penalties
- Cancellation is effective at the end of your current billing period
After Cancellation
- Access retention: You retain full access to premium features until the end of your paid period
- No pro-rata refunds: You will not receive a refund for the remaining days in your billing period
- Account downgrade: Your account automatically downgrades to the free tier
- Data retention: Your content is preserved, but some features may be limited
- Re-subscription: You can re-subscribe at any time to regain premium access
6.4 Taxes
Subscription fees do not include applicable taxes, duties, or fees. You are responsible for paying all taxes associated with your use of the Service.
7. Service Availability and Modifications
7.1 Service Uptime
We strive to maintain high availability and reliability, but we do not guarantee uninterrupted or error-free access to the Service.
- Target uptime: We aim for 99.9% uptime for paid plans
- Scheduled maintenance: We may perform maintenance during off-peak hours with advance notice
- Unexpected downtime: Service interruptions may occur due to technical issues, hosting provider outages, or force majeure events
- No SLA for free tier: Free accounts are not covered by service level agreements
7.2 Service Modifications
We reserve the right to:
- Modify features: Add, change, or remove features at our discretion
- Update the platform: Release updates, patches, and improvements
- Discontinue features: Retire or sunset features with reasonable notice
- Change limits: Adjust storage, bandwidth, or usage limits with notice
We'll make reasonable efforts to notify you of significant changes that affect your use of the Service.
8. Account Termination and Suspension
8.1 Termination by You
You may terminate your account at any time:
- Go to Account Settings → Delete Account
- Follow the confirmation process
- Your data will be permanently deleted within 30 days
- This action is irreversible
8.2 Termination or Suspension by Us
We may suspend or terminate your account, with or without notice, if you:
- Violate these Terms: Breach any provision of this Agreement
- Engage in fraudulent activity: Fraud, payment disputes, or chargebacks
- Fail to pay: Non-payment of subscription fees
- Abuse the Service: Excessive resource usage, spamming, or malicious activity
- Legal requirements: As required by law, court order, or regulatory authority
- Extended inactivity: No login activity for 2+ years (with advance notice)
8.3 Effect of Termination
Upon termination of your account:
- Your access to the Service is immediately revoked
- Your portfolio becomes inaccessible to visitors
- Your data may be deleted after a grace period (typically 30 days)
- Outstanding fees remain due and payable
- Provisions that should survive termination remain in effect (e.g., indemnification, liability limitations)
💾 Data Backup: We recommend regularly backing up your content. We're not responsible for data loss after account termination.
9. Disclaimers and Warranties
9.1 "AS IS" Service
⚠️ Important Legal Notice: The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, Portiqo disclaims all warranties, whether express, implied, or statutory, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties that defects will be corrected
- Any warranties arising from course of dealing or usage of trade
9.2 No Guarantees
We do NOT guarantee or warrant that:
- The Service will meet your specific requirements or expectations
- Your portfolio will achieve any particular results (views, job offers, etc.)
- The Service will be available at all times or in all locations
- Your data will never be lost (always maintain backups)
- The Service is free from bugs, viruses, or security vulnerabilities
10. Limitation of Liability
To the maximum extent permitted by law, Portiqo and its officers, directors, employees, agents, and affiliates shall NOT be liable for:
10.1 Types of Damages Excluded
- Indirect damages: Loss of profits, revenue, business opportunities, or goodwill
- Consequential damages: Loss of data, corruption of files, or system failures
- Incidental damages: Costs of substitute services or procurement
- Punitive damages: Penalties or exemplary damages
- Special damages: Any damages not directly and solely caused by our actions
10.2 Liability Cap
In no event shall our total aggregate liability to you for all claims arising from or relating to the Service exceed the greater of:
- The total amount you paid to Portiqo in the 12 months preceding the claim, OR
- $100 USD
10.3 Exceptions
The above limitations do not apply to:
- Liability for death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Liability that cannot be excluded by law
11. Indemnification (Your Agreement to Defend Us)
You agree to indemnify, defend, and hold harmless Portiqo, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Service: Any activity conducted through your account
- Your content: Content you upload, publish, or share through the Service
- Your violations: Breach of these Terms or violation of any law or regulation
- Infringement: Violation of third-party intellectual property, privacy, or other rights
- Misrepresentation: False or misleading information you provide
- Negligence or misconduct: Your willful or negligent acts or omissions
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.
12. Changes to These Terms
We may revise and update these Terms from time to time at our sole discretion.

When we make material changes to these Terms, we will notify you via:

15. Miscellaneous Provisions

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
15.2 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Portiqo regarding the Service.
15.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
15.5 Force Majeure
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
